Lindsey Clancy’s attorney, Kevin Reddington, stated that there is a «complete lack of evidence» supporting the claim that his client killed her three children. This statement was made during the first court hearing following a hung jury in the triple murder trial.

Clancy, 36, appeared in Plymouth County Court on September 29, more than three weeks after Judge William Sullivan declared a mistrial on September 4 due to the jury’s inability to reach a unanimous verdict. Reddington asked the judge to dismiss the charges against Clancy, arguing that the prosecution had not presented sufficient evidence of her criminal responsibility for the deaths of her children—Cora (5 years old), Dawson (3 years old), and Callan (8 months old)—in January 2023. He added that the prosecution had provided «absolutely no evidence» that she killed her children.

Reddington also noted that Clancy did not remember killing the children when she regained consciousness in the hospital after a suicide attempt on the same day. Furthermore, he stated that there was no evidence of her confession to the murders and criticized the investigation, pointing out the lack of DNA evidence during the trial.

After Reddington’s remarks, prosecutor Shannan Buckingham noted that his comments contradicted his arguments during the trial. During the court proceedings, Reddington argued that Clancy should not be held criminally responsible due to her mental health issues, including postpartum depression and bipolar disorder. The prosecution, on the other hand, maintained that despite her mental health problems, Clancy was aware of her actions and that they were intentional.

It is unclear whether the case will return to court after this hearing. Judge Sullivan is expected to consider the arguments from both sides when making a decision about the future of the case.
