The Menendez brothers were sentenced to life imprisonment without the possibility of parole in 1996 for the murder of their parents, Jose Menendez and Mary Louise «Kitty» Menendez. More than 20 years later, this may change. The Los Angeles County prosecutor has officially recommended a possible review of the sentence for Lyle and Erik Menendez. «I believe they have paid their debt to society», - Gascon said of Lyle and Erik, who have demonstrated rehabilitation during their time in prison by creating groups to work with unresolved trauma, creating groups to work with other inmates with physical limitations who may be treated differently," the prosecutor emphasized.
«Even in one case, Lyle [advocated] for other inmates regarding the conditions in which they live», - Gascon acknowledged, clarifying that «murder is not justified».
The prosecutor also noted a wave of public support following the premiere of the film «Monsters: The Lyle and Erik Menendez Story» and acknowledged new evidence confirming the brothers' claims of sexual abuse. In light of this, Gascon explained that while Lyle and Erik’s choice to kill their parents was wrong, they have grown.
«All of this was done by two young people», - the prosecutor added, referring to the fact that Lyle and Erik were 21 and 18 years old respectively when they fatally wounded their mother and father. «Now they are not so young. They had no hope of ever getting out of prison… I believe the brothers were subjected to a huge amount of dysfunction in the family and sexual abuse».
If the court moves forward with a possible review of Lyle and Erik’s sentence, they are likely to become eligible for parole, potentially allowing for their release. Since 2018, the brothers have been living in the Richard J. Donovan Correctional Facility in San Diego.
