Thirty-five years later, the Menendez brothers' case has once again garnered attention, largely thanks to the work of Ryan Murphy’s «Monsters: The Menendez Brothers Story», - followed by a documentary on Netflix featuring previously unreleased phone call recordings between the brothers and director Alejandro Hartman.

With increasing public interest in the case and allegations of sexual abuse, which Judge Stanley Weisberg prohibited in court, the Menendez brothers see a potential path to freedom. In early October 2024, former Los Angeles County District Attorney George Gascón announced that his office is reviewing the case after the brothers' lawyers requested prosecutors to recommend a sentence review, potentially leading to their release. However, with the transition to new prosecutor Nathan Hochman, the review process has slowed down.

Lyle and Erik were 21 and 18 years old, respectively, when they shot their parents, Jose and Kitty Menendez, in their Beverly Hills mansion in 1989. The couple was 40 years old at the time of their death.

In 1996, the Menendez brothers were found guilty of first-degree murder and sentenced to life imprisonment without the possibility of parole for killing their parents. Lyle was 28 years old and Erik was 25 at the time.

In February 2025, Erik shared his experience behind bars while participating in the TMZ podcast «2 Evil Men». Reflecting on his time in prison at around 29 years old, he explained: «I was taunted, beaten violently, and it was traumatic and ongoing. This is what many inmates go through when they are not part of the gang structure and come in alone. Prison can be tough, and there is a lot of suffering… I will not resist, I will not engage in conflict, and I had no one to turn to for help, and I was separated from Lyle».

As of 2025, Lyle is 57 years old, born on January 10, and Erik is 54, with a birthday on November 27.

On November 25, 2024, Lyle and Erik appeared in court for the first time in 28 years to consider new evidence related to their case. The hearing, scheduled as a status conference, was not expected to lead to any immediate decisions but could impact the next steps in their efforts to secure their release.

The hearing was set to begin at 10:30 local time, and the brothers were expected to participate via video link from their prison in San Diego, California. Judge Michael Jessic set strict restrictions for the hearing: no cameras would be allowed in the courtroom, and all mobile phones had to be placed in sealed packets.

A resentencing hearing was also scheduled for December 11, 2024, to give Hochman’s attorney additional time to complete the case review. California Governor Gavin Newsom also announced that he would postpone making a decision on clemency, preferring to pass it on to the newly elected district attorney. Newsom stated that he «recognizes that voters have entrusted District Attorney-elect Hochman with this responsibility» and «will wait for the review and analysis of the Menendez case by the District Attorney-elect before making any clemency decisions».

However, the December 2024 hearing was postponed. The Menendez brothers are set to return to court on March 20, 2025, for a hearing to determine whether their sentence should be reconsidered.

Prosecutors had previously presented a recommendation for the brothers' sentence review, offering them a new term of 50 years to life imprisonment. Since they were under 26 years old at the time of the crimes, they may be eligible for a resentencing
