However, the jury acquitted him of the following: a fourth case of pornography, conspiracy to obstruct justice in connection with his 2008 trial, three counts of conspiracy to receive child pornography, and two additional charges of enticement.
In 2023, a federal judge in Chicago sentenced Kelly to 20 years in prison for child pornography and enticing a minor. Reports indicate he was ordered to serve prison time for all but one of these crimes concurrently with his separate 30-year prison sentence for extortion and sex trafficking in New York. In 2024, the appellate court in Chicago upheld his 20-year prison sentence for his child sex crimes.
According to the Associated Press, as of April 2023, Kelly is located at FCI Butner, North Carolina. He was originally held at the Metropolitan Correctional Center in Chicago.
