Gary Siders Sr., the grandfather involved in the «House of Horrors» case in Ohio, has been cleared of all charges related to endangering children’s lives after a judge deemed him incompetent to stand trial. Judge Laina Fetherolf Rogers made this ruling on October 6, which resulted in all criminal charges against the 73-year-old Siders being dismissed.

Dr. Daniel D. Khrinko conducted a mental health evaluation of Siders prior to the ruling. The judge noted that the doctor did not make a definitive conclusion regarding the possibility of restoration but expressed the opinion that based on Siders' condition, a finding of incompetence could be supported. Consequently, all charges were dropped without prejudice, allowing the prosecutor to refile charges in the future.

The court also retained legal authority over Siders' case until it is heard in the general jurisdiction court of Vinton County. This court is now responsible for directing Siders to an appropriate facility for treatment of his unspecified mental illness. Siders was released from custody after the court determined that his medical issues and regular hospital visits did not pose a flight risk.

It is unclear when his civil proceedings for mandatory treatment will begin. The judge noted that all relevant records of his evaluation will be submitted to the court before these proceedings commence.

Siders Sr. was arrested along with his wife Christina, son Gary Siders II, and his wife Elizabeth in June after authorities discovered they were living in horrific conditions with 16 children from the younger generation. Deputies visited the family home for a separate matter but reported the state of the housing and that the children were locked in one room.

The 16 children, aged between 18 months and 18 years, were rescued within hours, and all adult family members were arrested. Ohio Attorney General Andy Wilson spoke about the state of the home at a press conference, noting that had they waited another 24 hours, there likely would have been one or more deaths among the children.

The children are now in the custody of the county. Meanwhile, Christina, 68, Gary II, 36, and Elizabeth, 33, remain in jail on a $ 300,000 bond. All three are charged with 19 counts of endangering children, and the couple has also been charged with additional offenses for engaging in sexual conduct with minors. They have all pleaded not guilty to all charges.
