Hannah Gutierrez-Reed, a former armorer on the film «Rust», - is seeking to have her case dismissed after the case against Alec Baldwin collapsed, her lawyer confirmed.
«We intend to file on the same basis of discovery violations that have occurred throughout her case and continue to occur», - said Jason Bowles to NBC News after Baldwin, 66, saw his case collapse last week. «The things I learned today were absolutely shocking».
In October 2021, Baldwin was holding a prop gun on the set of Rust during a scene being filmed at the Bonanza Creek Ranch in New Mexico. The gun fired a live round, fatally wounding cinematographer Halyna Hutchins. The actor was charged with one count of involuntary manslaughter, and his trial began earlier this month. However, on July 13, District Judge Mary Marlowe Sommer dismissed his case after his attorneys successfully argued that prosecutors had withheld evidence that could have been related to Hutchins' death.
«There is no way to fix this wrong», - the judge said that day, according to the publication. «The sanction of dismissal is the only justified remedy».
The «Aviator» actor visibly cried in court and hugged his wife, Hilaria Baldwin, after the judge made her decision. Shortly before that, Gutierrez-Reed's lawyer, Bowles, told NBC News that the judge «absolutely correctly decided the law and the facts» regarding the dismissal of Baldwin’s case.
«The judge found that the state committed a transgression», - Bowles added. «I mean, seeing Mr. Baldwin, knowing what he’s going through, knowing what Hannah Gutierrez-Reed is going through right now, being in jail, and that the state committed a series of discovery violations… it’s devastating».
For her part, Gutierrez-Reed was convicted in March of involuntary manslaughter related to Hutchins' death. As a result, she was sentenced to 18 months in prison.
The tragedy on the set of the film Rust has become a highly publicized dilemma for Baldwin. Shortly after Hutchins' death was reported, the actor and armorer faced criticism from the public. Since then, new safety standards have been implemented on many film sets for anyone working with prop guns
