Halle Berry and her ex-husband Olivier Martinez have once again found themselves in court discussing custody of their 13-year-old son Maceo. On October 1, 2026, Martinez received a temporary restraining order against Berry, claiming that the actress physically assaulted their son and choked him during a conflict a month prior. Following an emergency filing, he also obtained temporary primary physical custody and sole overnight custody of Maceo, which will be reviewed at a hearing on October 16, 2026.
Berry has firmly denied the allegations, calling them «completely unfounded and deliberately misleading». According to Martinez, on September 26, 2026, Maceo called him and asked to be picked up from Berry’s home, claiming that she «physically attacked him and choked him». Martinez also stated that he heard Berry continue to yell at their son during their conversation.
According to court documents, the judge limited Berry’s visitation time to Mondays, Tuesdays, Saturdays, and Sundays from 10 a.m. to 8 p.m. However, the court denied Martinez’s request for sobriety monitoring for Berry, citing «insufficient information». Martinez also asked the court to order Berry to undergo psychological evaluation and drug and alcohol testing.
In response to the allegations, Berry stated that she was deprived of the opportunity to contact Maceo on his 13th birthday and described the incident as a «playful struggle». She claimed that she never choked her son or restricted his breathing. Berry’s team also stated that Martinez had premeditated his statement without discussing the incident with her.
Martinez insists that Maceo wants to testify in court and share his version of events, while Berry believes this could harm their son. Martinez’s attorney, Patrick Baghdasarian, stated that «the child is the primary victim in this situation» and should have the opportunity to testify about what happened.
Meanwhile, 18-year-old Nahla Aubry, Berry’s daughter from her former partner Gabriel Aubry, supported her mother in her affidavit, stating that she has never seen Berry physically abuse Maceo.
