Kilmar Abrego Garcia was mistakenly deported to El Salvador, despite legally residing in the United States for over ten years. The White House carried out his deportation in March 2025, then acknowledged it was an «administrative error» on their part. The Supreme Court also ruled against the Donald Trump administration regarding his deportation. However, Abrego Garcia is still in prison in El Salvador, and the President of El Salvador recently commented on his case.

Learn more about Abrego Garcia and his deportation below.

Abrego Garcia is a 29-year-old resident of Maryland. He was considered an illegal resident in 2011 when he immigrated to the US at the age of 16. However, in 2019, an immigration judge granted him «withholding of deportation» because his life would be in danger due to gang violence in El Salvador. Since then, Abrego Garcia had been living legally in the US until his deportation in 2025.

According to TIME, Abrego Garcia got married while in the US and has three disabled children.

In 2019, local police in Maryland accused Abrego Garcia of ties to the MS-13 gang. Abrego Garcia denied the accusations, and no charges were filed against him.

Trump and his administration called for the enforcement of the Alien Enemies Act of 1798. This law gives the president the authority during wartime to deport anyone who is not a US citizen. As a result, Trump planned to deport Venezuelans and other immigrants whom his administration accused of belonging to the Tren de Aragua gang. The administration stated that they planned to send more non-citizens to a mega-prison in El Salvador known as CECOT (also known as the Center for Confining Terrorists).

During a visit to the White House in April 2025, President of El Salvador Nayib Bukele said, «How can I send him back to the United States? Will I be his smuggler? Of course, I will not do that. The question is absurd».

Therefore, Bukele will not be sending Abrego Garcia back to America.

It is unclear when — or if — Abrego Garcia will return home to the US, now that the President of El Salvador has refused to send him back to the states.

After the White House acknowledged its «administrative error» in Abrego Garcia’s deportation, the Supreme Court ordered to facilitate his return home.

Attorney General Pam Bondi later stated that Abrego Garcia was in the US illegally and that it is not the US’s responsibility to bring him back to the states, according to CNN
