President-elect Donald Trump surprised many with his appointment of Matt Gaetz as Attorney General this Wednesday.

Gaetz’s appointment to this position, typically held by more experienced politicians with significant legal experience, raised serious concerns about the qualifications of the 42-year-old politician. Additionally, the Florida politician has been the subject of controversial discussions, as he has faced a lengthy Department of Justice investigation that began in 2019 on charges of sex trafficking and obstruction of justice.

As the situation unfolds, here is everything you need to know about the role, next steps after the appointment, and much more.

The Attorney General of the United States is the head of the Department of Justice (DOJ) and serves as the chief law enforcement officer and legal advisor to the President and the executive branch. The Attorney General is responsible for overseeing the entire justice system in the United States, including agencies such as the Federal Bureau of Investigation (FBI), the Drug Enforcement Administration (DEA), and the U.S. Marshals Service.

The Attorney General represents the government in legal disputes and, in some cases, may personally argue cases in the Supreme Court. Additionally, the Attorney General sets priorities for federal prosecutors nationwide and ensures consistent enforcement of federal law across the country.

The Attorney General of the United States is appointed by the sitting President. While the candidate does not necessarily have to be a lawyer, most historically appointed individuals have extensive legal experience, often with experience in law enforcement agencies, private practice, or government service.

After the President appoints a person, the appointment is sent to the U.S. Senate. The Senate Judiciary Committee typically holds hearings to question the candidate and assess their qualifications. This process includes examining the candidate’s professional history, legal views, and ability to lead the Department of Justice.

After the committee hearings, the appointment is presented to the full Senate for a vote. Confirmation requires a simple majority (51 votes). If the Senate confirms the appointment, the individual is officially appointed as Attorney General.

The Attorney General of the United States serves at the discretion of the President and holds the position until resigning, being replaced, or the President leaving office. There is no fixed term, but the Attorney General typically serves throughout the President’s term. However, the sitting President can replace the Attorney General at any time, and the appointment must be approved by the Senate.

Merrick Garland is the current Attorney General of the United States, appointed by President Joe Biden in 2021.
