Court denies Lindsay Clancy’s request to dismiss child murder charge
Judge William Sullivan rejected another attempt by attorney Lindsay Clancy to have her charges of murdering three children dismissed, which occurred in January 2023. The decision was made on October 1, nearly a month after the case ended in a mistrial on September 4, when the jury was unable to reach a unanimous verdict.

During the hearing on September 29, Clancy’s attorney, Kevin Reddington, argued that the charges should be dropped because, in his opinion, prosecutors failed to prove that Clancy killed her three children — Cora (5 years old), Dawson (3 years old), and Callan (8 months old) — during the nearly seven-week trial. Reddington had previously not disputed that Clancy had suffocated her children but claimed that she was not criminally responsible due to postpartum psychosis and other mental health issues she was facing at the time of the children’s deaths. In his new approach, he stated that a thorough investigation into the children’s deaths was not conducted, and authorities «immediately assumed that this woman was guilty».

Two days later, the judge denied the motion to dismiss the charges. Sullivan noted that the evidence presented was sufficient to satisfy any reasonable court. Despite Sullivan’s refusal to dismiss the charges after more than three attempts by the attorney, the future of the case remains unclear. Plymouth County Prosecutor Timothy Cruz and Clancy’s defense team did not comment on whether plea negotiations were taking place. Cruz also did not indicate whether the prosecution wants the triple homicide case to be retried.

Additionally, Clancy has another motion to dismiss the case currently awaiting consideration in court. In late August and early September, jurors deliberated for seven days before concluding that they could not reach a unanimous decision. Eleven out of twelve jurors found Clancy not guilty by reason of insanity, however, one juror refused to agree with that verdict.
