The court overturned Timothy Busfield’s child sexual abuse charges
A judge in New Mexico has dismissed the indictment against Timothy Busfield on charges of child sexual abuse. On October 16, Judge Joseph Montaño granted the actor’s motion to dismiss four counts of criminal sexual contact with a minor.

In court documents obtained by Us, the judge cited prosecutorial misconduct, including incorrect information provided to the grand jury regarding witness summons and procedures that effectively deprived the jury of hearing the requested witnesses. The judge noted that such actions violated grand jury law, which undermined the integrity of the judicial process. However, the state reserves the right to initiate new criminal charges against the 69-year-old Busfield.

Bernalillo County District Attorney’s Office representative Nancy Laughlin stated that their office has received the court’s decision and is currently evaluating its next steps. The ruling was issued nearly four months after Busfield’s attorneys filed the motion to dismiss the charges.

The actor, known for his role in the series «The West Wing», - was first accused of child sexual abuse in February. According to Albuquerque police, Busfield is accused of inappropriate behavior with a child actor on the set of the series «The Cleaner» between late 2022 and early 2024. Busfield maintains his innocence and claims that his interactions with children on set were not «weird».
